Michigan Medical Marijuana

Proposal 1, commonly known as the “Michigan Medical Marihuana Act” was approved by 63% of Michigan voters on November 4, 2008 it took effect one month later on December 4, 2008.

The Michigan Medical Marihuana Act allows patients who suffer from one of the states approved conditions to obtain a written designation from their physician that states the patient would be aided by the use of medical marijuana. After a patient receives a written recommendation from their physician to possess and use marijuana for medical purposes, they are permitted to use marijuana in accordance with the laws set by the state medical marijuana program.

Michigan Medical Marijuana Regulations Regarding Possession & Cultivation

Patients are permitted to possess up to two and a half (2.5 ounces) of usable cannabis and cultivate no more than 12 marijuana plants which must be kept in an enclosed, locked facility. Patients may only cultivate their own medicine if they have not designated a primary caregiver for themselves. The Michigan Supreme Court has ruled that dispensaries are illegal and as a result patients must grow their own medicine.

Michigan’s medical marijuana program is unique in that it does not permit dispensaries to operate in the state. This ultimately requires that patients or their caregivers must grow their medicine themselves.
